This Privacy Statement applies to all personal data processed by VintaClassics of everyone who uses our services, website vintaclassics.com or other applications and mobile platforms (‘Platform’), such as our visitors, bidders and customers on all domains related to Shellton BV, including all underlying entities and subsidiaries. Personal data are all data that we may associate with you, such as your name, address, post code, town/city, telephone number, or e-mail address. However, data such as your IP address and IBAN number are also personal data, as well as other data that are unique to you, such as your VintaClassics bid details or purchase history.

As part of creating an account, VintaClassics collects personal data that are necessary to provide you with services and to perform the agreement with you.

- What is the purpose of the processing of personal data?
VintaClassics can collect, process and store your personal data within certain limits to ensure that VintaClassics can continue to function optimally. These processing operations are based on different legal grounds, depending on the specific circumstances. We handle your personal data with care and take both technical and organizational measures to protect them.
VintaClassics processes and uses your personal and other data for the following purposes:
Statutory obligations
In certain cases, VintaClassics requires your personal data in order to comply with statutory obligations.
For example, we may use your personal data to combat money laundering and terrorism, to assist competent authorities in their investigation or to comply with tax legislation.
Anti-money laundering legislation and combating terrorism
VintaClassics must comply with international legislation and regulations, such as measures to combat money laundering. VintaClassics is obliged to prevent, recognize, combat and report money laundering. VintaClassics processes the following personal data for this purpose:

Tax legislation
VintaClassics is obliged to process data of its customers, so that tax obligations of VintaClassics / Shellton B.V. and the customer can be fulfilled. VintaClassics is obliged to provide tax authorities with information and to share your details with such authorities, such as the Dutch Tax and Customs Administration and others. VintaClassics processes the following personal data for this purpose:

- E-mail address and telephone number;
- Invoice details;
- VAT and/or Chamber of Commerce number (in the case of a business account).
Judicial authorities
VintaClassics is obliged to assist and inform judicial authorities. These include the police, the Public Prosecution Service, courts or supervisory authorities, including but not limited to the Netherlands Authority for the Financial Markets (AFM), the Netherlands Authority for Consumers and Markets (ACM) and the Dutch Data Protection Authority (AP).
This may include all data belonging to you that VintaClassics has collected, processed and stored in the context of the relationship between you and VintaClassics.
Privacy law
VintaClassics must also process your personal data, precisely in order to protect your privacy. VintaClassics must be able to respond appropriately when you want to exercise your rights or when the Dutch Data Protection Authority asks us a question.

VintaClassics would like to approach you as a current or potential customer and inform you about possible interesting auctions. To receive commercial offers, such as our digital newsletter, your explicit consent will be requested. You will receive newsletters only to which you have subscribed. This information will be processed in your account so that we can show which newsletter you have subscribed to. The personal data that VintaClassics collects, processes and stores for this purpose are:

You have the right to object at any time to the processing of your personal data for direct marketing purposes. - Whose personal data do we process and how do we obtain these data?
We process the personal data of everyone who has or has had direct or indirect contact with VintaClassics, such as bidders and customers.
We obtain the information directly from you when you visit our websites or other applications and mobile platforms, create an account and enter certain information, and when you contact our customer service department.
- Personal data that we collect automatically
Regardless of whether you participate at one of our auctions, we automatically collect certain information when you visit our websites or other applications and mobile platforms. Examples include your IP address or the date and time you logged in to our websites and/or apps.
- Processing of special personal data
VintaClassics will not collect and/or process any special categories of personal data from you, such as racial or ethnic origin, political opinions, religious beliefs and genetic data, as defined in the GDPR Article 9.
Sensitive personal and other data, such as creditworthiness, are required only in the case of special lots at auctions, such as vehicles or other expensive goods, in order to ensure that bidders can actually buy such lots, and to avoid problems with payment and delivery. In some cases, we also work together with civil-law notaries, lawyers and bankruptcy trustees in order to comply with the legal requirements for the transfer of ownership.
- Security of your data
VintaClassics takes the security of your personal data seriously and we have therefore taken both technical and organizational measures to secure your personal data
- How long do we retain your data?
We retain your personal data no longer than is strictly necessary for the purposes for which they were collected. After this, the data will be erased as soon as they are no longer required, taking into account the statutory data retention obligation. For this purpose, the legal basis is used as a starting point and the retention period is adjusted to the period in which VintaClassics needs the data in order to achieve the objective of the processing.
- With whom will your data be shared?
VintaClassics cooperates with other parties to provide you with services and will disclose information only to third parties that fall within the following scope:
- Affiliated companies: affiliated companies belonging to VintaClassics / Shellton B.V. and its subsidiaries, if these companies offer comparable data protection and the transfer of data is permitted.
- Service providers: we engage other companies and individuals to work on our behalf. Examples of service providers are companies offering delivery services or payment processing (credit card, direct debit collection and purchase on account) or professional bidding agents acting on behalf of customers. If VintaClassics uses the services of third parties, it concludes agreements with these parties, from which no independent obligation arises for them with regard to the processing of personal data. These service providers have access to the personal information (including name and address details, e-mail address and telephone number) needed to perform their work (e.g. having lots delivered). However, they are not allowed to use these data for other purposes.
- Sellers: Your personal information may be shared with our Sellers. For example, if you make a purchase where the lot is shipped to you, we will share your name, address and contact information (phone number and email address) with the Seller so that the shipment can be made. We will also share your information with the Seller if you have a complaint about your purchase and VintaClassics has failed to reach a resolution as part of its mediating role. The Seller will then contact you directly. Please note: If your contact details change during an auction, during a complaint or shortly after a complaint is settled, we may provide your ‘old’ contact details to the Seller if there is reason to believe that this is necessary for the Seller to obtain the rights under the purchase agreement
- In all other cases, you will be informed if your personal data are to be sent to third parties and you will be given the opportunity to consent to this separately.
For each disclosure, we will ensure that the required contractual safeguards for the protection of your personal data are in place.
In all cases where personal data within the above context are transferred to third parties in countries outside the European Economic Area (EEA), we will transfer the data only in accordance with this Privacy and Cookie Statement and the applicable privacy protection legislation.
In principle, all data will be processed, where possible, within the EU and will not be exchanged with parties outside the EU. Data may be exchanged by VintaClassics with a non-EU country only if the recipient can guarantee the same level of data protection, either on the basis of the legislation in force in that country or through separate agreements as prescribed by the EU in the EU format for binding agreements.
- What rights can you exercise with regard to your data?
Within the framework of the GDPR, you as a citizen have a number of rights with respect to VintaClassics / Shellton B.V. It is after all your personal data that are being processed. You can invoke these rights by sending an e-mail to dpo@vintaclassics.com Requests in which you invoke your rights on the basis of the GDPR will be dealt with within 30 days at the latest. If we are unable to process your request within 30 days, we will provide you with a response within 30 days stating our reasons for not being able to process your request within that period. In that case, we will have 90 days to deal with your request.

You have the right to know how we handle your personal data in a proper and transparent manner and what rights you can exercise in that respect. In this Privacy and Cookie Statement, we have therefore explained in detail what personal data we collect from you and how we handle such data.
Right to access
You have the right at all times to access the personal data we have about you. In addition, we may ask you questions to verify your identity. Requests for access to your data will be processed within 30 days at the latest.
Right to rectification
You have the right to have your personal data rectified if they are incorrect or outdated and/or to have them supplemented if they are incomplete. You can do this yourself 24/7 in your account.
Right to object
You are entitled to object to the way in which we process your personal data. This right applies to the personal data we use for direct marketing, such as newsletters. You can ask us to cease using your personal data for personalised e-mails relating to our auctions. You can adjust this yourself in your account. In addition, this right also applies to other personal data relating to you that we process on the basis of our legitimate interest.
Right to data portability
You have the right to receive personal data that you have issued to us within the framework of the agreement concluded with us, so that you can keep these personal data in a database of your own or that of a third party. You can submit a request for this purpose to our Data Protection Officer by sending an e-mail. Please include your name, e-mail address and account ID.
